Signing a contract in Germany as an expat: what you need to know

Germany has some of the strongest consumer and employee protections in Europe. Many clauses that landlords and employers routinely include in contracts are actually void under German law — even if you signed them. Understanding these protections is essential for any expat navigating the German system.

Rental contracts: the Schoenheitsreparaturen trap

Schoenheitsreparaturen clauses require tenants to repaint and perform cosmetic repairs when they move out. These are one of the most litigated areas of German rental law. The Bundesgerichtshof has ruled that rigid renovation interval clauses (requiring repainting every 3-5 years regardless of condition) are void. Only condition-based clauses that assess actual wear may be enforceable. If your lease includes a rigid timeline clause, it is almost certainly void.

AGB-Recht: your secret weapon

AGB-Recht (sections 305-310 of the BGB) governs standard contract terms. If a contract was not individually negotiated — which applies to most rental leases and employment contracts — unfair terms are automatically void. This applies even if you signed them voluntarily. Courts assess whether a clause creates a significant imbalance to your disadvantage.

Employment protections

After six months of employment, you are protected by the Kuendigungsschutzgesetz (dismissal protection law). Your employer needs a valid reason to terminate your contract. Notice periods increase with seniority — up to seven months after 20 years. Non-compete clauses must include Karenzentschaedigung (compensation of at least 50% of your last salary) or they are void.

The deposit rules

Rental deposits (Kaution) are limited to three months cold rent. The deposit must be held in a separate interest-bearing account. Your landlord must return it within a reasonable period after you move out — typically three to six months, to allow for utility bill settlements.
