Signing a contract in Luxembourg as an expat: what you need to know

Luxembourg is a unique legal environment — a small country with three official languages, a large expat population, and a legal system rooted in French civil law but with significant local variations. Nearly half the workforce are cross-border commuters from France, Belgium, and Germany, which creates specific contract considerations.

Rental contracts

Luxembourg rental law is governed by the loi du 21 septembre 2006. The deposit is limited to three months rent and must be returned within three months of the end of the lease. Rent increases are regulated and must follow the legal formula based on the invested capital of the property. Leases can be in French, German, or Luxembourgish — make sure you understand which language version is legally binding.

Employment contracts

The Code du travail luxembourgeois provides strong employee protections. Fixed-term contracts (CDD) are limited to two renewals and a maximum total duration of 24 months. Trial periods cannot exceed six months for qualified positions and three months for others. Non-compete clauses are limited to twelve months and specific sectors — they must be proportionate and justified.

Cross-border considerations

If you live in France, Belgium, or Germany and work in Luxembourg, your employment contract is governed by Luxembourg law but your social security situation may be split between countries. Tax treaties between Luxembourg and neighbouring countries determine where you pay tax. The 25-day rule (soon to be 34 days) determines how many days you can work from home before your tax situation changes.

The language question

Contracts in Luxembourg may be in French, German, or Luxembourgish. Employment contracts are most commonly in French. If you receive a contract in a language you do not fully understand, get key clauses translated independently. In case of dispute, the language version specified as authoritative in the contract will prevail.
